1. Company details
Devinita B.V., established in Amstelveen, registered with the Chamber of Commerce under number 85933171, is responsible for the sale and delivery of wine and related products through the website[www.devinita.nl].
2. Applicability
These general terms and conditions apply to all offers, orders, agreements and deliveries of Devinita B.V.. By placing an order, the customer agrees to these terms and conditions.
3. Age Limit
It is prohibited by law to sell alcoholic beverages to persons under the age of 18. By placing an order, the customer declares to be 18 years of age or older. Identification may be requested upon delivery. If the delivery person or our delivery service suspects that the recipient is under the age of 25, valid identification may be requested. If identification cannot be shown, delivery will be refused.
4. Offer and agreement
All offers on the website are without obligation and subject to availability. An agreement is concluded when we send an order confirmation to the customer’s specified e-mail address.
5. Prices and payment
All prices stated are in euros and include VAT, unless otherwise indicated. Any shipping costs will be stated separately. Devinita B.V. reserves the right to change prices or correct errors in the offer. Payment must be made via the payment methods offered on the website. Delivery will take place only after receipt of full payment.
6. Delivery and delivery time
We deliver within the Netherlands, unless otherwise agreed. Orders are usually shipped within 1-3 business days. The stated delivery times are indicative. We are not liable for delays caused by third parties or force majeure situations.
7. Right of Withdrawal
In accordance with the Distance Selling Act, the customer has the right to cancel the purchase without giving any reason within 14 days of receiving the order. The customer must inform us within this period via e-mail or the model withdrawal form. Products must be returned unopened, undamaged and in their original packaging. Return shipping costs shall be borne by the customer unless there is an error or defect on our part. Upon receipt of the return, the purchase price will be refunded within 14 days.
8. Exclusion of right of withdrawal
The right of withdrawal does not apply to opened bottles or products that spoil quickly or have a limited shelf life.
9. Complaint Procedure
Complaints about products or delivery can be reported within 7 days of receipt via info@devinita.com. We aim to deal with complaints within 3 working days and always seek an appropriate solution.
10. Liability
Devinita B.V. is not liable for any damage, direct or indirect, arising from the use of the products supplied, unless there is intent or gross negligence. In all cases, the liability is limited to the amount of the order in question.
11. Intellectual Property
All content on the website and the Devinita B.V. brand are protected by copyright, trademark law and/or other intellectual property rights. Nothing may be reproduced or published without written permission from Devinita B.V..
12. Privacy and data protection
We value your privacy. Personal data is used exclusively for order processing, communication and – if consent is given – marketing purposes. For more information, please refer to our privacy policy.
13. Applicable law and disputes
All agreements are subject to Dutch law. Any disputes will be submitted exclusively to the competent court in the district in which Devinita B.V. has its registered office.
